How many dwellings can be built on 56 Bayside Drive (Lot 28)?

The Far North District district scheme provides for multiple-unit developments (based on 300 sq m per unit) as a restricted discretionary activity.  Therefore it is possible to build up to 3 units on Lot 28 which has an area of 1078 sq m.

Are the Pohutukawa trees in the Estate protected in any way?

There are tree protection covenants on all the beachfront titles to protect the Pohutukawas. The trees can be pruned by an authorized arborist under Council supervision to remove any broken, diseased or dangerous branches - but they cannot be cut down.

Are there any restrictions or building covenants on sections in the Estate?

An 8 meter height restriction applies to all sections. All beachfront sections have a restricted building line which appears on the titles. Building on the seaward side of that line requires a report from a geotechnical engineer. Several owners have built over the line with Council approval. Apart from these covenants, anyone wanting to build has to comply with  the requirements of the Far North District Council District Scheme (FNDC) which is available on line.

Are the sections fully serviced?

All sections in the Estate connect to the Far North District Council's sewerage system and the Doubtless Bay Water Supply Company has reticulated the Estate which owners can connect to for a fee.

Can foreigners buy property in the Estate?

From October 22, 2018 all overseas persons (other than Australians and Singaporeans) require Overseas Investment Office approval to purchase residential land in New Zealand.
